Win Your Chance to Paint a Mural at the Darlo Bar Promotion Minimal/Abridged Terms and Conditions 

 

Competition is open to AU residents, 18+ who are willing for their design to be painted as a mural/front board on 30/09/23 at Darlo Bar. Entry is from 1am (AEDT) 1/7/23 to 11.59pm (AEDT) 15/09/23 by designing a mural integrating the 4 Pines logo (in accordance with Promoter's specifications outlined in the T&Cs). Entry submissions are received by sending a copy of the design to muralcomp@darlobar.com.au. Max 1 entry per person. Winning designs determined by a panel. Extended Terms and Conditions

Competition Period

Entry Period: 1am (AEDT) 1/8/23 to 11.59pm (AEDT) 15/09/23

Who can enter?

Only Australian residents who:

(a) are aged 18 or over; and willing to, and have the skills and ability to, replicate their Design as a mural or front board in accordance with the specifications provided by the Promoter on 30/09/23 at the Venue - Darlo Bar, at a time to be determined by the Promoter.

Who can't enter?

Directors, officers, management and employees (and their immediate families) of:

(a) the Promoter; and

(b) the agencies, companies or participating premises associated with this competition.

Entry instructions

To enter, you must during the Entry Period:

Design a 4 Pines mural integrating the 4 Pines logo which can be recreated in paint at the specified location at the Venue; and

send an email to muralcomp@darlobar.com.au attaching an image of your design and provide your full name and contact number.

The Promoter is not responsible if your mobile device/desktop is not sufficiently capable for the purpose of submitting an entry, including having the requisite photograph capability.

Your Design must not be obscene, offensive, malicious, discriminatory, indecent or (in the Promoter's opinion) otherwise objectionable or inappropriate (for example it must not include nudity or language the Promoter deems offensive). 

In addition your Design should comply with ABAC Responsible Alcohol Marketing Code available at http://www.abac.org.au/wp-content/uploads/2019/06/ABAC-Responsible-Alcohol-Marketing-Code-21-June-2019.pdf.

All entries/Designs will be screened by the Promoter prior to being accepted as an entry in this competition.

How many winners will there be and how will they be chosen?

This is a game of skill. Chance plays no part in how a winner will be selected.  

There are two stages to the judging period.

Shortlist Judging

All valid entries received will be reviewed and judged by the Promoter (and/or by appointed judge/s) based on creativity, originality, brand suitability/practicality and commercial viability.  At the end of the Entry Period, the entries judged to be the best will be shortlisted to proceed to the voting stage.  The number of shortlisted entries will be as determined by the Promoter.

Shortlisted entrants are not entitled to a prize, unless they are subsequently deemed the winner. All shortlisting judging decisions are as determined by the Promoter (and/or by appointed judge/s), in their absolute discretion.

Major winner

At the end of the Voting Period, the valid shortlisted entry which the Promoter deems to be the best will win the major prize. 

Runner up winners

The next 2 valid shortlisted entries which the Promoter deems to be the best will each win a runner-up prize. Runner-up prizes will be distributed in descending order of value as outlined below in 'Runners-up prizes'. 

 

The Promoter reserves the right at any time during the judging and winner determination stages to contact entrants in relation to their Design and their participation in this competition, including but not limited to requiring entrants to prove (in the manner and timeframe specified by the Promoter), the entrants ability to replicate their Design as a mural/front board as specified.  Such correspondence with entrants does not mean that the entrant is, or will be, shortlisted or a winner.

What can I win?

There are 3 prizes available – 1 major prize and 9 runner up prizes.

Major prize

The major prize is:

• $2,000 awarded to the winner via EFTPOS card;

• 1 x 4 Pines winners pack as determined by the Promoter, valued at $150; 

• the opportunity for the winner to paint the agreed winning Design at a mural at the location specified at the Venue on 30/09/23. In addition the prize also includes $500 worth of paint/supplies (as agreed between the winner/artist and Promoter).  The winner/artist is responsible for providing any other materials needed and for arranging their own transport and accommodation at their own cost, to participate in the major prize.  

Runner up place

Runner up 1

• $500 awarded to the winner via EFTPOS card;

• 1 x 4 Pines winners pack as determined by the Promoter, valued at $150;

• 1 x printed skate deck trophy of your Design art , valued at $100; and 

• the opportunity for the winner to paint the agreed winning Design at a front board at the location specified at the Venue on 30/09/23.  In addition the prize also includes $500 worth of paint/supplies (as agreed between the winner/artist and Promoter).  The winner/artist is responsible for providing any other materials needed and for arranging their own transport and accommodation at their own cost, to participate.

 

Runner up 2

• 1 x 4 Pines winners pack as determined by the Promoter, valued at $150 and

• the opportunity for the winner to paint the agreed winning Design at a front board at the location specified at the Venue on 30/09/23.  In addition the prize also includes $500 worth of paint/supplies (as agreed between the winner/artist and Promoter).  The winner/artist is responsible for providing any other materials needed and for arranging their own transport and accommodation at their own cost, to participate.

 

1. These Terms and Conditions incorporate and must be read together with the details outlined in the table above.  Information about prizes and how to enter forms part of these Terms and Conditions.  By entering, you accept these Terms and Conditions.  


Entry 


2. Your entry must be received during the Entry Period and will be deemed to be received only when received by the Promoter. The Promoter is not liable for any problems with communications networks.  You are responsible for your own costs associated with entering.  If you enter using automatically generated entries or multiple phone numbers/email addresses/addresses/aliases, you may be disqualified.  
3. Every Design must be your original work and not copied.  
4. To the extent permitted by law, you unconditionally and irrevocably consent to the Promoter copying and amending your entry (including your Design) and using (or allowing others to use) your entry (including your Design) and any rights in relation to your entry in a way that would otherwise infringe your moral rights in your Design, to publicise this competition or for any other purpose.  These rights are perpetual, royalty free, world-wide, irrevocable and transferable.  For example, the Promoter may publish all or any part of your entry or any amended version of it.  The Promoter may also decide not to publish an entry, to cease publication of an entry, or to publish an edited entry.
5. The Promoter may edit, or request that you edit, your Design at any stage during or after this competition.  If you do not follow the Promoter's instructions in this regard, your participation in this competition may be deemed invalid (and if you have already been deemed a shortlisted entrant or the winner, you may forfeit all entitlement and involvement in this competition).
6. You warrant that your entry (including your Design) does not breach any third party rights (for example, intellectual property rights) and its use by the Promoter or any other person will not breach such rights nor otherwise breach any law (for example, it is not defamatory, in contempt of court or in breach of any privacy law). 


Prizes


7. Prize/s and all elements of prize/s must be taken as and when offered or will be forfeited, and if forfeited, the Promoter will not be liable. Prize/s are subject to any additional terms and conditions imposed by the relevant supplier or the Promoter.
8. Where relevant, the Promoter accepts no responsibility if one or more of the events or activities awarded as part of the prize are abandoned, called off or postponed for any reason.  In that case you forfeit your entitlement to that event/activity.  
9. The Venue makes no representations in relation to the period of time which they will display the mural/front board at the Venue.  The Venue may leave the mural/front board in place for any period of time, or they may edit, re-paint, cover or remove the mural/front board at any time, in their absolute discretion.


General


10. Any failure by you to comply with the conditions imposed by the prize supplier(s) may result in the prize being cancelled or withdrawn without liability for the Promoter or the prize supplier(s). 
11. If you or your entry are deemed by the Promoter to breach these Terms and Conditions including if the prize is on set dates and you are unable to take the prize on the relevant date/s, your entry (or at the Promoter's discretion, all of your entries) may be discarded.  The Promoter may, at any time, require you to produce documentation to establish to the Promoter's satisfaction the validity of your entries (including documentation establishing your identity, age, place of residence and place of employment).  Failure by the Promoter to enforce any of its rights at any stage does not waive those rights. 
12. You must not:

(a) tamper with the entry process;

(b) engage in any conduct that may jeopardise the fair and proper conduct of the competition;

(c) act in a disruptive, annoying, threatening, abusive or harassing manner; (d) do anything that may diminish the good name or reputation of the Promoter or any of its related entities or of the agencies or companies associated with this competition;

(e) breach any law; or

(f) behave in a way that is otherwise inappropriate.  

13. The Promoter is not liable for entries, prize claims or correspondence that are misplaced, misdirected, delayed, lost, incomplete, illegible or incorrectly submitted.
14. If any dispute arises between you and the Promoter concerning the conduct of this promotion or claiming a prize, the Promoter will take reasonable steps to consider your point of view, taking into account any facts or evidence you put forward, and to respond to it fairly within a reasonable time.  In all other respects, the Promoter’s decision in connection with all aspects of this competition is final.
15. Prizes cannot be transferred or exchanged nor for cash.  Without limiting any other term of these Terms and Conditions, all prizes (and elements of prizes) must be taken as and when specified, or will be forfeited with no replacement.  Any unused balance of paint or funds in respect of the paint will be forfeited by the winner.  The prize values  include any applicable GST.  You agree that if a prize (or element of a prize) is unavailable for any reason the Promoter may provide another item of equal or higher value.
16. If this competition cannot run as planned for any reason beyond the Promoter's control, for example due to software, hardware or communications issues, unauthorised intervention, tampering, fraud or technical failure, the Promoter may end, change, suspend or cancel the competition or disqualify affected entries/entrants.
17. The Promoter is not responsible for any tax implications arising from you winning a prize.  You should seek independent financial advice.  If for GST purposes this competition results in any supply being made for non-monetary consideration, you must follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.


Liability


18. Nothing in these Terms and Conditions restricts, excludes or modifies any consumer rights under any statute including the Competition and Consumer Act 2010 (Cth).
19. Subject to the previous paragraph, the Promoter and the agencies and companies associated with this competition are not liable (including in negligence) for any loss (including indirect, special or consequential loss or loss of profits), expense, damage, personal injury (including allergies, skin conditions or other reactions, as relevant), illness or death suffered in connection with this competition or any prize, except for any liability which under statute cannot be excluded (in which case that liability is limited to the greatest extent allowed by law).   
20. Without limiting the previous paragraph, the Promoter and the agencies and companies associated with this competition are not liable for any loss of, damage to or delay in delivery of prize/s.  
21. This competition is in no way sponsored, endorsed or administered by, or associated with any social media platform, including Facebook, Instagram and Twitter.  You provide your information to the Promoter and not to any social media platform.  You completely release any relevant social media platforms from any and all liability.
